HelloBeach.com provides a forum where property owners and prospective renters can exchange information regarding vacation rental properties. The property owners who wish to list their rental properties must subscribe to our fee-based service. HELLOBEACH.COM IS NOT A PARTY TO THE AGREEMENTS ENTERED INTO BY RENTERS AND PROPERTY OWNERS, and therefore, does not take any responsibility for the subsequent agreements that arise between renters and property owners or managers.

No Warranties: Limitation of Liability

This web site includes information, documents, and materials (collectively, the "Contents") that are subject to change without notice. HelloBeach.com expressly disclaims any obligation to keep Contents up to date or free of errors or viruses, or to maintain uninterrupted access to this web site. General Provisions and Obligations

By subscribing to our service, you agree that, to the best of your knowledge, the information provided, including your contact and rental property information, is true, accurate, and complete. Should events arise such that the information provided is no longer true, accurate, and complete, you further agree to update immediately the information provided, including your contact and rental property information. HelloBeach.com reserves the right to terminate or suspend your account upon discovering that the information provided is not true, accurate, or complete.

HelloBeach.com is designed to be a family-friendly website. Notwithstanding the above, HelloBeach.com subscribers are solely responsible for the content as it relates to the properties listed. Therefore, by using HelloBeach.com, you agree that you may be subject to content that is offensive or objectionable. In the event that HelloBeach.com is made aware of a subscriber who posts obscene or offensive content or content that is otherwise harmful to minors, HelloBeach.com will suspend or terminate the account of said subscriber. The prohibition against obscene or offensive content or content that is harmful to minors applies to both the written descriptions and the photographs provided.

You may include one (1) web site address (URL) in the property description or additional information section of your property listing as long as the URL takes users to a web page that is specific and exclusive to the property you are listing. You may NOT include a web site address (URL) that takes users to a web page or site that has other properties listed.

Example: The URL "www.mistral24.com" is permissible because it pertains to one specific property. The URL "www.resortquest.com" would not be permissible since it takes users to a site that contains more than one property.

Failure to abide by these guidelines may result in the deactivation of a property listing and/or suspension of all privileges on HelloBeach.com.

Ownership of Content

HelloBeach.com does not have any ownership in any of the information provided by account subscribers.

Reservation of Rights

With the exclusion of the properties listed, all Contents (including, without limitation, the graphics, icons, and overall appearance of the HelloBeach.com web site) are the property of HelloBeach.com. HelloBeach.com does not waive any of its proprietary rights therein including, but not limited to, copyrights, trademarks, and other intellectual property rights. This web site may not be used for any commercial purpose without the prior written consent of HelloBeach.com. The availability of any Contents through this web site shall under no circumstance constitute a transfer of any copyrights, trademarks, or other intellectual property rights of HelloBeach.com to any web site user or any third party. Hold Harmless Agreement and Indemnity

If you elect to allow a HelloBeach.com renter to enter your rental premises for any reason, you agree to do so at your own risk. To the fullest extent allowed by law, you waive any claims against, and agree to indemnify and hold harmless HelloBeach.com, its affiliates, employees, officers, directors and contractors from, all claims or liability of every type (including court costs and legal fees) for injury or death to any person or for damage to property arising out of or relating to the renter's presence on the your offered on HelloBeach.com. This agreement applies to you and any other party entering into rental agreements for the rental property offered.

Removing your account from the HelloBeach Website

To delete your account, complete the account deletion form. Following confirmation of receipt of such request, all account information will be deleted from the servers within 10 days.

Law Governing Agreement

This Agreement shall be construed in accordance with the laws of Georgia; any and all disputes shall be submitted to the jurisdiction of Georgia, disregarding conflicts of law, forum and venue. Venue shall be proper in Superior Court of Fulton County, Georgia.
